What Information We Collect
In general, you can use and visit our Website and Services without submitting any personal information; however, in order to utilize and access certain features on our Website and Services, you will need to submit your personal information. We collect information from you when you register on our Website, subscribe to our newsletter, respond to a survey, inquiry about our Services, contact us for customer care or technical support, and utilize our cloud-based services (e.g., when processing personal information via one of our SaaS offerings). When using certain features on our Website and Services, you may be required to enter your personal information, including without limitation, your name, telephone number, e-mail address and phone number. If you have questions about a Systech product that you have already purchased, we may also collect your system serial number.
Most web browsers permit you to set your web browser to block or delete all cookies, including cookies associated with our services, or to indicate when a cookie is being set by us. However, it’s important to remember that our Website and Services may not function properly if you set your browser to reject cookies.
We may also use other third-party service providers to track our visitors. Most browsers also allow you to turn on a feature commonly referred to as “Do Not Track” so that websites and service providers will not track your behavior over time and across websites. We do not combine the information collected through the use of any third-party service providers with personally identifiable information.
How We Use Information
Any of the information we collect from you may be used in the following ways:
How We Share Information
Our policy is to not sell, trade, disclose, share, or otherwise transfer to outside parties your personally identifiable information unless you give us your prior consent or direct us to do so. We may however share your information with third parties who assist us in operating our Website and Services, conducting our business, or servicing you (e.g., marketing, analytics). We may also share your information when we believe the disclosure is appropriate to comply with the law or legal process, enforce our policies, or protect ours or others rights, property, or safety.
We implement commercially reasonable technical and organizational measures to protect your information collected through the Website and Services, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however, and we cannot guarantee absolute security.
Our Website and Services are not directed to children under the age of 13 and we do not knowingly collect personal information from children. If you are under the age of 13, please stop using our Website and Services. It is our policy not to knowingly solicit or permit children under the age of 13 to provide their personal information for any purpose.
EU-U.S. Privacy Shield
Systech complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States. Systech has certified to the Department of Commerce that it adheres to the Privacy Shield Principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access, and Recourse, Enforcement and Liability, and the 16 Supplemental Principles (collectively, “Privacy Shield Principles“), and such adherence is subject to investigation and enforcement by the U.S. Federal Trade Commission.
Systech’s participation in the Privacy Shield applies to all personal information transferred from the European Union and European Economic Area to Systech in the United States, including (but not limited to), personal information collected or otherwise processed by Systech on behalf of its Europe-based customers and other users of its Website and Services. Systech will comply with the Privacy Shield Principles in respect of such personal information. If there is any conflict between the terms in this policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. Systech’s adherence to the Privacy Shield Principles may be limited to the extent necessary to meet national security, public interest, or law enforcement requirements.
Systech’s accountability for personal information that it receives under the Privacy Shield and subsequently transfers to a third party is described in the Privacy Shield Principles. In particular, Systech remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process personal information on its behalf do so in a manner inconsistent with the Privacy Shield Principles, unless Systech proves that it is not responsible for the event giving rise to the damage (if any).
Individuals whose personal information is transferred to Systech under the Privacy Shield have the right to access their personal information maintained by Systech, and to correct, amend or delete such information where it is inaccurate or processed unlawfully, as described in the Privacy Shield Principles. To exercise any of these rights, please email the Systech Legal Department at Legal@SystechOne.com.
In addition, Systech provides individuals with certain choices regarding how we use and disclose personal information. First, if Systech uses your personal information for a materially different purpose than that for which it was originally collected or discloses your personal information to a third party (other than third party providers acting on our behalf), we will first provide you with a clear, conspicuous and readily available mechanism to opt-out of any such use or disclosure (e.g., by sending you an email seeking your consent). In addition, all of our email communications include the ability to opt-out from receiving future emails, except those emails that are necessary to provide you with the Services you have requested or purchased. If you have any questions about your choices regarding how we use and disclose your personal information, or how to exercise these choices, please email the Systech Legal Department at Legal@SystechOne.com.
We encourage you to contact us should you have a Privacy Shield-related (or general privacy-related) complaint or inquiry by emailing the Systech Legal Department at Legal@SystechOne.com. For any complaints that cannot be resolved with Systech directly, Systech has chosen to cooperate with JAMS, an alternative dispute resolution provider, to resolve such complaints at no cost to you. Please visit www.jamsadr.com/eu-us-privacy-shield for more information or to file a complaint. As further explained in the Privacy Shield Principles, a binding arbitration option will also be made available to you in order to address residual complaints not resolved by any other means.
Systech shall also apply the Privacy Shield Principles (as applicable) to personal information received from Switzerland.
